1. Agreement to Terms

By accessing and using NotDeadYet (the "App"), you accept and agree to be bound by these Terms and Conditions ("Terms"). These Terms govern your use of NotDeadYet's platform, application, and services (collectively, the "Services").

If you do not agree to these Terms, you should not use the App. NotDeadYet is designed for personal safety and peace of mind through daily check-ins.

NotDeadYet is a daily check-in application that helps users stay connected with their emergency contacts. Our Services include:

• Emergency contact notifications when check-ins are missed

• Optional location sharing features

3. User Responsibilities

As a user of NotDeadYet, you agree to:

• Provide accurate, truthful, and complete emergency contact information
• Keep your contact information up to date
• Obtain consent from your emergency contacts before adding them
• Use the Services only for lawful and legitimate purposes
• Not attempt to gain unauthorized access to our systems
• Not use the Services to harass, harm, or deceive others
• Understand that missed check-ins may cause distress to your emergency contacts

5. Service Limitations

You acknowledge and agree that:

• Notification Delivery: Email notifications may be delayed, blocked by spam filters, or not delivered due to technical issues
• Emergency Contact Response: We cannot guarantee that your emergency contacts will check or respond to notifications
• Technical Issues: The App may experience downtime, bugs, or technical difficulties
• Internet Dependency: The App requires internet connectivity and may not function without it
• Device Compatibility: The App may not work on all devices or operating systems

6. Check-in Records and Data

Regarding check-in records and user data:

• Check-in records are stored securely on our servers
• You are responsible for maintaining the security of your account
• We may retain check-in records even after account deletion for safety and legal reasons
• Check-in data may be used to improve our Services
• Location data (if enabled) is only shared with your designated emergency contacts

7. Limitation of Liability

To the fullest extent permitted by law, NotDeadYet shall not be liable for:

• Any injury, harm, or death resulting from failed or delayed emergency notifications
• Any indirect, incidental, special, or consequential damages
• Missed check-ins or notification failures
• Actions taken or not taken by emergency contacts
• Technical issues, service interruptions, or data loss
• Unauthorized access to your account or data

8. Indemnification

You agree to indemnify, defend, and hold harmless NotDeadYet, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to your use of the Services, your violation of these Terms, your emergency contacts' actions or inactions, or any injury or harm resulting from notification failures.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

10. Emergency Contact Consent

By adding an emergency contact, you represent and warrant that:

• You have obtained the consent of that person to be added as your emergency contact
• You have informed them that they may receive notifications if you miss check-ins
• You have provided them with accurate and current email information
• They understand the nature of the notifications they may receive

11. Intellectual Property

The App and its original content, features, and functionality are owned by NotDeadYet and are protected by international copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works of our content
• Use our trademarks, service marks, or logos without permission
• Reverse engineer or attempt to extract our source code

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason, including if you:

• Breach these Terms
• Use the App for illegal or harmful purposes
• Harass or abuse other users or emergency contacts
• Attempt to compromise our systems or security

13. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to the new terms taking effect. Your continued use of the App constitutes acceptance of the changes.
